  • Q. Is it expensive to Write a Will?

    Prices start from £300 for a single straightforward Will.

  • Q. I am young, should I make a Will?

    Yes, unfortunately accidents can happen. It is especially important if you have a house, partner, children, pets or goods over the value of £20,000.

  • Q. What happens if I die without a valid Will?

    Without a valid Will (except in the smallest value estates) an application has to be made to the Court before any steps can be taken in dealing with a deceased's affairs. This inevitably leads to increased costs and delay.

  • Q. I have remarried and have children from a previous relationship will this affect their inheritance?

    Absolutely, without a Will your children could end up not inheriting anything from you when you die.

  • Q. Can I make provision for my pets in my Will?

    Yes. You can set out your wishes for your pets future care in your Will.

  • Q. Is my English Will valid when I move to Scotland?

    It depends... An English Will would need to be 'proved' to the Court as being validly executed before it could be acted on. Further, there are legal differences under Scottish law as to how you can leave your estate. It is therefore important to seek advice and make a fresh Will if appropriate.

  • Q. What is a 'mirror' Will?

    Mirror Wills are Wills that are identical but the parties are reversed. For example a spouse or civil partner leaves everything to the other spouse/civil partner whom failing to their children.

  • Q. Who is a Partner and why do I need to consider them in my Will?

    A. A Partner is someone you are in a relationship with but you are not married to or have entered into a civil partnership with. A spouse (your husband or wife) or a registered civil partner are automatically entitled to a share in your estate even if you die without a Will. A Partner on the other hand does not have any such automatic rights. For example, if you own a house together the house may have to be sold and your share of the proceeds divided between your family. It is therefore important to make a Will if you want your Partner to inherit anything from you.

  • Q. What is a Power of Attorney?

    It is a document giving someone you trust legal authority to make decisions and deal with institutions on your behalf if you are no longer able to do so.

  • Q. What is a Living Will?

    It is a document stating your wishes regarding medical care when you are unable to make such decisions
